‘Can we get divorced without going to court?’

Most divorces can proceed without going to court. Court attendance is only required where an agreement cannot be reached, whether with regard to child arrangements, or in respect of the division of finances. Agreement between separating couples can be achieved in numerous ways. A separating couple can attend mediation, where an independent mediator can guide both parties in reaching an agreement. Alternatively, Collaborative practice allows separating couples to work with specially trained lawyers to resolve disputes respectfully through a series of meetings. Support can also be provided by lawyers in constructive negotiation to liaise with a former partner or their solicitor to reach an agreement. In these cases, once an agreement is reached, your divorce can be finalised and  sent to the court for approval without the need for court attendance.
